Acceptable Use Policy
This policy protects recipients, customers, carriers, and Aether Agent's network standing.
Last updated: June 27, 2026
1. Compliance-first use
You may use the Service only for lawful business communications with appropriate consent, notices, opt-out handling, and honoring of quiet hours, do-not-call lists, STOP requests, unsubscribe requests, and recipient preferences.
You must maintain accurate opt-in records, truthful campaign descriptions, accurate sender identification, compliant message flows, and current privacy and terms links for every messaging program.
You must comply with the TCPA, Telemarketing Sales Rule, CAN-SPAM, CTIA guidance, carrier policies, 10DLC and toll-free requirements, state telemarketing and mini-TCPA laws, call recording laws, do-not-call rules, privacy laws, consumer protection laws, and all rules that apply to your audience and use case.
You must promptly investigate and remediate complaints, opt-out failures, high bounce rates, spam reports, carrier warnings, blocked traffic, suspicious lead sources, or other signs that your communications may be unwanted or non-compliant.
2. Prohibited content and behavior
You may not use the Service for spam, phishing, fraud, deception, impersonation, harassment, threats, hate, sexual exploitation, malware, illegal goods or services, high-risk financial claims, debt relief scams, misleading health claims, unauthorized political persuasion, or any content carriers or law prohibit.
You may not attempt to evade filtering, rotate numbers to avoid enforcement, hide sender identity, scrape recipients, purchase non-compliant lead lists, continue messaging opted-out recipients, or interfere with the Service or third-party networks.
You may not send content involving illegal drugs, counterfeit goods, weapons trafficking, human trafficking, sexual services, gambling where prohibited, payday loans, debt relief, credit repair, social security claims, get-rich-quick claims, deceptive lead generation, or other categories commonly restricted by carriers unless Provider expressly approves the use case in writing.
You may not upload malware, secrets, payment card data, protected health information, children's data, or highly sensitive data into unsupported parts of the Service.
3. AI-specific restrictions
You may not configure AI agents to misrepresent that they are human when disclosure is legally required, make guarantees you cannot honor, provide regulated professional advice, collect sensitive information without authorization, or make unlawful commitments on your behalf.
You are responsible for reviewing scripts, objectives, knowledge sources, guardrails, and escalation behavior before activating an agent.
You may not use AI features to make decisions that produce legal or similarly significant effects about employment, credit, housing, insurance, education, criminal justice, healthcare, or public benefits unless you have appropriate legal authority, human review, and written approval from Provider.
You may not prompt agents to bypass safety controls, impersonate real people, hide opt-out instructions, pressure vulnerable recipients, or continue conversations after a recipient revokes consent.
4. Security and network abuse
You may not probe, scan, load test, stress test, or attack the Service or any third-party network without written authorization. You may not bypass rate limits, authentication, permissions, billing controls, abuse controls, or usage restrictions.
You may not use the Service to send viruses, adware, spyware, worms, exploit payloads, credential-harvesting content, or links to malicious or deceptive destinations.
5. Enforcement
Elav8 AI LLC may suspend traffic, remove content, disable features, require remediation, reject campaigns, block integrations, or terminate access if use violates this policy or creates legal, carrier, deliverability, security, reputational, billing, or operational risk.
Fees already incurred remain payable even if traffic or access is suspended for policy reasons.
Provider may require additional documentation, consent evidence, website changes, privacy or terms updates, traffic sampling, message edits, opt-in flow changes, or customer attestations before restoring access.
